2.- Delivery terms

Users undertake to make proper use of the Website in accordance with the Law and this Legal Notice. Users will be liable to EJASO or third parties for all loss caused by breaching this obligation.

It is expressly forbidden to use the Website for purposes harmful to the property or interests of EJASO or that in any other way overload, damage or render useless the networks, servers and other computer equipment (hardware) or computer products and applications (software) of EJASO or third parties.

3.- Intellectual and industrial property

The Website, including its graphic design, as well as its contents, which are understood to include but not limited to texts, photographs, graphics, images, software and other contents, are the intellectual property of EJASO or of third parties who have licensed it to EJASO, and none of the exploitation rights recognised by current legislation on intellectual property may be understood to have been transferred to the Users. In particular, Users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the content except to the extent necessary for browsing the Website, in cases authorised by law or when expressly consented to by EJASO.

The distinctive signs (trademarks, trade names, etc.) are owned by EJASO and it may not be understood that access to the Website grants Users any rights over the aforementioned trademarks, trade names and/or distinctive signs.

4.- Exclusion of liability

4.1.- Availability of the service

EJASO endeavours to keep the Website up and running and error-free, but the User agrees to use the Website at his/her sole risk. The Website is provided "as is" without warranty of any kind, either express or implied, and, except as may be legally required under applicable law, we make no warranties of merchantability or fitness for a particular purpose, nor do we warrant that access to or use of the Website will be uninterrupted or error-free. Likewise, access to the Website requires services and supplies from third parties, including transport through telecommunications networks, whose reliability, quality, security, continuity and operation is not the responsibility of EJASO and is not under its control. EJASO shall not be liable for failures or disconnections in telecommunications networks or other services provided by third parties that cause the suspension, cancellation or interruption of access to the Website.

4.2.- Of the contents and services linked to through the Website

The Website may include links that allow the User to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, EJASO acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce ("LSSI") (Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y el Comercio Electrónico”) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of the unlawfulness and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with unlawful or inappropriate content, he/she may notify EJASO in accordance with the procedure and effects established in clause 5 of this Legal Notice, and in no case shall this notification entail the obligation to remove the corresponding link.

Under no circumstances should the existence of Linked Sites presuppose the existence of agreements with the managers or owners of the same, nor the recommendation, promotion or identification of EJASO with the statements, content or services provided.

4.3.- Website security

The connection to the website is made via open networks so that EJASO does not control the security of the data communication and the equipment connected to the Internet. It is the User's responsibility to have adequate tools for the prevention, detection and disinfection of harmful computer programmes or malicious software. EJASO shall not be liable for any damage caused to Users' computer equipment during connection to the Website by third parties or for any lack of security or confidentiality of the information transmitted by third parties' equipment and telecommunications networks or as a consequence of software or hardware vulnerabilities in Users' own equipment.

5.- Communication of activities or services of an unlawful and inappropriate nature

In the event that the User or any other third party becomes aware that the Linked Sites, content or any other service provided through the Website are illicit, harmful, denigrating, violent or contrary to morality, or that in any other way infringe the rights of third parties, you may contact EJASO indicating the following points:

• Personal data of the caller: name, address, telephone number and e-mail address. EJASO will be responsible for the processing of the personal data that you voluntarily provide us with the sole purpose of responding to your request. You may exercise your rights in accordance with the Privacy Policy. The omission of any of this information may mean that your request will not be processed, without prejudice to any voluntary enquiries that EJASO may wish to make.
• Description of the facts revealing the unlawful or inadequate nature of the service.
• In the event of violation of rights, such as intellectual and industrial property rights or any other rights whose existence cannot be deduced by EJASO, documentation must be provided to prove the existence of the title or legal right that has been violated. In addition, the personal details of the owner of the infringed right must be provided when this is a person other than the communicating party, as well as the representation document to act on behalf of the latter in these cases.
• Express declaration that the information contained in the claim is accurate. The receipt by EJASO of the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, actual knowledge of the activities and/or contents indicated by the communicating party.

7.- Validity and Termination

EJASO reserves the right to introduce modifications to this Legal Notice, by publishing any changes in the same form in which this Legal Notice appears or through any type of communication to Users or any other appropriate procedure.

Therefore, the temporary validity of this Legal Notice coincides with the time of its publication, until it is totally or partially modified, at which time the modified Legal Notice will come into force. Consequently, the User must read this Legal Notice carefully each time he/she accesses the Website.

EJASO may terminate, suspend or interrupt, at any time without prior notice, access to this Website or to any of the services provided through it, without the User being able to claim any compensation whatsoever. After such termination, the prohibitions on the use of the contents set out above in this Legal Notice shall remain in force.
